We will also ensure that you receive the best possible representation by a solicitor or barrister at any court hearing that takes place "south of the border".

You may have received court papers in relation to an action already raised within the jurisdiction of England and Wales. If so, contact us to see if we can help.

Alternatively, it may be appropriate and preferential that you raise a court action within the jurisdiction of England and Wales rather than in Scotland. For example, under Scots Matrimonial  Law, inheritance and property owned by you prior to the marriage generally do not count as "matrimonial property", and therefore, cannot be claimed by your spouse. Whereas under English Matrimonial Law they often do and consequently can be potentially claimed.

Occasionally, it may be necessary to raise a court action within the jurisdiction of England and Wales with no choice of doing so under Scots Law. For example in a child contact dispute, generally, the relevant court to commence any action will be that nearest to where the child usually resides. Consequently, depending upon your individual circumstances, it may be in your interest to commence or defend a court action south of the border rather than in Scotland.

Such jurisdiction issues can be complex and require specialist advice. We can advise you on both English and Scots Law in relation to such matters along with the best way forward for you.
